New Bill to Promote ICHRAs

Yesterday, U.S. Representatives Beth Van Duyne, Claudia Tenney, and Kevin Hern introduced a new bill, the Small Business Health Options Awareness Act of 2025, which requires the Small Business Administration ("SBA") to provide more outreach and information about the availability of ICHRAs as a means for small businesses to deliver health care coverage for their employees.  The tri-agencies issued regulations effective in 2020 that permit employers to offer ICHRAs to help employees pay for individual health insurance and Medicare premiums.  The press release for the bill states that “low awareness of this option has prevented more widespread utilization.” 

The bill requires the SBA to actively disseminate information the tri-agencies developed about ICHRAs. This outreach must occur via Small Business Development Centers, SBA district offices, and standard SBA communication tools (press releases, social media, website postings).  The goal is to “make sure small businesses are aware of and understand ICHRAs are a flexible, tax-advantaged way for employers to help employees pay for individual health coverage.”
