Health and Human Services Regulatory Agenda

It is going to be a BUSY Fall and Spring if the Department of Health and Human Services' ("HHS") regulatory agenda is any indication.

HHS has posted its regulatory agenda, with a number of regulations coming out soon:

  • The Centers for Medicare and Medicaid Services ("CMS") Proposed Rule Transparency in Coverage is expected in September 2025.
  • CMS Proposed Rule HHS Notice of Benefit and Payment Parameters for 2027 is expected in November 2025.
  • CMS Final Rule Independent Dispute Resolution Operations is expected in November 2025.
  • CMS Final Rule Requirements Related to Air Ambulance Services, Agent and Broker Disclosures, and Provider Enforcement is expected in December 2025.
  • Office for Civil Rights (OCR) Proposed Rule on Nondiscrimination on the Basis of Disability in Programs and Activities Conducted by the Department of Health and Human Services is expected in January 2026.
  • CMS Proposed Rule on the Requirements Related to Advanced Explanation of Benefits and Other Provisions Under the Consolidated Appropriations Act 2021 is expected in April 2026.
  • OCR Final Rule HIPAA Privacy Rule: Changes to support, remove barriers to coordinated care, and individual engagement is expected in May 2026.
  • OCR Final Rule HIPAA Security Rule to Strengthen the Cybersecurity of Electronic Protected Health Information is expected in May 2026.
